3. Purposes for which personal data is collected

a) Data processing for the fulfillment of the contract concluded between us (Section 6 (1) (b) GDPR)

In order to fulfill the existing contractual relationship, provide services as stipulated and send you contractual documents, we or a third party or external processor authorized by us will process the following data pertaining to you or your company as provided by you upon conclusion of the contract or in the course of the contractual relationship:

-    Personal details (name, company address, telephone, fax number, e-mail address and home page as applicable),

-    Bank data (IBAN, name, account holder) and payment information (sales data in payment transactions),

For this purpose we save the data in our contact database.

b) Data usage with your consent (Section 6 (1) (a) GDPR)

In the event of a promotional approach we will contact you only via the communication channels to which you have specifically consented. We use the data provided by you for the following purposes:

-     Contact by telephone, e-mail etc. for product information

-     Sending the newsletter, if expressly requested by you

-     Quality assurance: For the purpose of continuous improvement of our products and services we conduct surveys on your satisfaction, level of recommendation and experience with your contractual relationship.

-     New offers: At the end of your contract, we will contact you to inform you of offers that may be of interest to you.

-     General and personalized advertising.

c) Data processing on the basis of legitimate interests (Section 6 (1) (f) GDPR)
Information on products and services

Our aim is to establish, maintain and evaluate the customer relationship with you and to offer you relevant and optimized products and services.

To achieve this, we use your customer, contact and payment data.

In order to avoid duplication and retain only one data set for you, we reconcile your customer data with our customer database.

4. Categories of recipients of personal data

To the extent permitted by law, we share personal your data with our group companies and external service providers:

-     Group companies for the execution of your contract and for reporting.

-     Sales partners for targeted address, conclusion, execution and post-termination of the contract, as well as commission invoicing.

-     Credit institutions and payment service providers for invoicing and handling payments.

-     IT service providers for the maintenance of our IT infrastructure.

-     Public bodies in justified cases (e.g. social insurance carriers, tax authorities, police, public prosecutor’s office, regulatory authorities).

-     Collection service providers and attorneys for the collection of debts and enforcement of claims in court. Should it become necessary to pass on personal data for a collection procedure (customer and contact data, payment, consumption and claims data) to a collection service provider, we will notify you in advance of the intended conveyance.

5. Cross-border data transfer

The transfer of personal data to countries outside the European Union or EEA must be carried out on the basis of provisions of Section 49 (1 a) – g) GDPR.

6. Credit assessment and scoring

If we have made payments in advance, e.g. in the case of a purchase on account, we will obtain a credit report on our contractual partner from the credit agency Creditreform on the basis of mathematical-statistical methods in order to safeguard our legitimate interests.

For this purpose we will send the data required for a credit check to the above-named service provider. We use the information received on the statistical probability of a shortfall in payment to make a balanced decision on the establishment, execution or termination of the contractual relationship. The credit report may include probability values (score values) that are calculated based on scientifically recognized mathematical-statistical procedures and may include address data. Your concerns with regard to data protection will be taken into account at all times in accordance with legal provisions.

7. Retention period of data

We store your data for the term of the existing contract, and upon termination of the same until the completion of the tax audit of the last calendar year in which you were our customer.

In the event of statutory retention obligations, we are required to store the data until expiry of the specified period. Upon expiry of the statutory retention period, which largely ensues from commercial and tax law (in particular commercial code and revenue code) the data will be deleted.

For the purpose of sending you promotional material we will continue to store your data unless you object to its use, revoke your consent or the promotional address is no longer legally permissible. We will save your other data for as long as we need it for the fulfillment of the specific purpose (e.g. contract performance or processing) and will delete it once the purpose is no longer applicable.

8. Processing of personal data on the website (website analysis tool, cookies, etc.)

Collection, use and processing of personal data can take place in the following cases:

a) Access data / Server log files

Instrument Systems Optische Messtechnik GmbH collects data each time its website is accessed (so-called server log files). The following data or categories of data can be collected:

-    Name of the web page opened
-    Date and time of the request
-    Browser type and version
-    The user’s operating system
-    Referrer URL (the previously visited web page)
-    IP address

Instrument Systems Optische Messtechnik GmbH uses this data solely for statistical purposes and for technical optimization of the website.

b) Contact

When a user contacts Instrument Systems Optische Messtechnik GmbH by Internet, the user’s information is stored in order to process the request and possible follow-up requests. The user provides this data voluntarily.

c) Registration

Data entered during registration for demonstration software are employed for the purposes of using the demonstration software. The user can be informed via e-mail about offers or registration-relevant information such as changes to the scope of the offer, or about technical circumstances. The data collected are shown in the input mask during the registration process. The mandatory information includes the user’s name, company, address, city, country, postal code and e-mail address. Other details are optional.

d) Cookies

Cookies are text files that enable the storage of device-specific information on the user’s system. This information can then be used to save the user settings for future visits to the website, to realize various website functions and to collect information about how the website is used in order to improve it.

e) Piwik

Instrument Systems Optische Messtechnik GmbH uses the privacy-enhancing web analytics tool Piwik to learn more about user behavior on its website and use this knowledge to continuously improve its services. Piwik uses cookies that save device-specific information as well as information about user behavior in anonymized form.

Users can contradict the collection and evaluation of their data at any time by completing the Opt-Out form below. This sets a so-called opt-out cookie. If all browser cookies are deleted, the opt-out cookie must be set again.

f) Google Analytics

This website uses Google Analytics, a web analytics service provided by Google Inc. (“Google”). Google Analytics uses so-called “cookies”, text files that are stored on the user’s computer and enable an analysis of how the website is used. The information generated by the cookie about the use of this website by the user is generally transmitted to and stored in a Google server in the USA. The IP address is anonymized using the function “_anonymizelp” or “ga(‘set’, ‘anonymizeIp’, true)” before transmission to Google.

The IP address transmitted by your browser in the context of Google Analytics is not merged with any other data held by Google. Users can prevent storage of these cookies by selecting the appropriate browser settings. In common browsers, such as Internet Explorer or Chrome, web site tracking can be disabled in the Security & Privacy settings. However, we wish to point out that in this case, you cannot use the full functionality of this website. 9. Rights of the data subject

You may at any time request information on the data we have stored concerning you and demand rectification in the case of errors. Furthermore, you may demand the restriction of processing, convertibility into a machine legible format or deletion of the data provided by you, should it no longer be needed.

In addition, you have the right at any time to revoke the permission to utilize your data, based on public or legitimate interests. Insofar as we process your data on the basis of the consent provided by you, you may revoke this consent at any time with effect for the future. Upon receipt of your revocation we will no longer process your data for the purposes stated in the consent.

10. Right of appeal to a supervisory authority

You may also exercise the right of appeal at any time to a supervisory authority. We are subject to the jurisdiction of the Bavarian Data Protection Authority (Bayerische Landesamt für Datenschutzaufsicht), Postfach 606, D-91511 Ansbach. Alternatively, you may contact your local supervisory authority.
